1. Acceptance of These Terms

By accessing or using dmtcartel.com (the “Site”) or any mobile or desktop application, API, or service we provide (collectively, the “Services”), you agree to be bound by these Terms of Use (“Terms”) and to our [Privacy Policy]. 2. Who We Are

dmtcartel.com (“dmtcartel,” “we,” “our,” or “us”) operates an online peer-to-peer (“P2P”) marketplace that allows third-party sellers (“Sellers”) to list certain botanical, chemical, or psychedelic products—including, but not limited to, N,N-Dimethyltryptamine (“DMT”) and related accessories—for prospective purchasers (“Buyers”). We are a venue only: we do not manufacture, test, store, ship, or hold title to any substances, nor do we broker or consummate sales on behalf of Buyers or Sellers.

3. Eligibility

You may use the Services only if:

• You are at least 21 years old (or the age of legal majority where you live, if higher);

• You have not been suspended or removed from the Site; and

• You can form a legally binding contract under applicable law.

4. Compliance with Laws & Regulations

1. Local Responsibility. Controlled-substance laws vary widely. You are solely responsible for understanding and complying with all laws, regulations, and restrictions that apply to you, including import/export rules, licensing, prescription requirements, and age limits.

2. No License or Advice. dmtcartel does not provide legal, medical, or regulatory advice, nor do we hold any license to distribute controlled substances. Nothing on the Site should be construed as encouragement to violate the law.

3. Restricted Jurisdictions. If possession, purchase, or use of any product listed on the Site is illegal where you reside or access the Site, you must refrain from using the Services.

• You must create an account to list, buy, or sell on the marketplace.

• Provide accurate, complete information and update it as necessary.

• Keep your login credentials confidential. You are liable for all activity that occurs under your account.

• Our Content. Logos, graphics, software, and Site text are our property or our licensors’ property, protected by copyright, trademark, and other laws.

• User Content. You grant dmtcartel a non-exclusive, worldwide, royalty-free license to use, host, reproduce, and display any content you submit for the purpose of operating or improving the Services. You represent that you own or have the necessary rights to your content.

• DMCA Policy. If you believe your copyrighted work has been infringed, submit a takedown notice to [admin@dmtcartel.com].

8. Risk Disclosure & Assumption of Risk

Psychoactive substances carry inherent medical, psychological, and legal risks. By purchasing or consuming any product obtained through the Site, you voluntarily assume all risks and waive any claim against dmtcartel arising from injury, prosecution, loss, or damage.

9. Disclaimers

1. No Warranties. The Services are provided “as-is” and “as-available.” We disclaim all warranties, express or implied, including any warranty of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation.

2. Third-Party Listings. We do not verify, endorse, or guarantee the legality, quality, or safety of any listing or Seller.

10. Limitation of Liability

To the fullest extent permitted by law:

• Indirect Damages. dmtcartel will not be liable for any indirect, incidental, special, consequential, or punitive damages (including lost profits, data, goodwill, or business opportunities).

• Aggregate Liability. Our aggregate liability to you for any claim will not exceed US $100 or the amount of fees you paid to us in the twelve months preceding the claim, whichever is greater.

Some jurisdictions do not allow certain disclaimers; those limitations apply only to the extent required by law.

You agree to defend, indemnify, and hold harmless dmtcartel, its affiliates, officers, directors, employees, and agents from any claim, demand, action, or loss (including reasonable attorneys’ fees) arising out of or relating to:

• your breach of these Terms;

• your violation of any law or third-party right; or

• your listing, purchase, possession, or use of any product obtained through the Services.

12. Termination

• By You. You may close your account at any time by following the instructions in your dashboard.

• By Us. We may suspend or terminate your account and refuse current or future use of the Services if you violate these Terms or we suspect unlawful activity, without liability.

Sections 8 – 15 survive termination.

13. Governing Law & Dispute Resolution

• Governing Law. These Terms are governed by the laws of [Insert Jurisdiction], without regard to conflict-of-laws rules.

• No Waiver. Our failure to enforce any provision is not a waiver of our right to do so later.

• Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may freely assign these Terms.

• Force Majeure. We are not liable for any delay or failure to perform due to causes beyond our reasonable control (e.g., natural disasters, acts of government, internet outages).
